Introduction

Florida State University (FSU) obtains insurance coverage for general liability, automobile liability, building and contents coverage, Workers’ compensation, federal civil rights and court awarded attorney fees through the State of Florida. This program is established by the Florida Legislature and administered by the Department of Financial Services (DFS).

Additional insurance coverages can be purchased at the cost to the department from the Department of Management Services (DMS). Insurance programs purchased through DMS are coverages offered to all Florida governmental entities which includes FSU.

The FSU Department of Environmental Health and Safety (EH&S)serves as the liaison to the DFS and DMS. In addition, EH&S coordinates these insurance programs on behalf of FSU. Information and guidance on the University Insurance Program coverages are provided in this document.

The objective of this Insurance program is to provide information and guidance to University departments about each of the programs available to ensure that the University’s interests are properly insured.

Definitions

Accidental Death & Dismemberment - Coverage in the event of death due to accident, usually in combination with dismemberment insurance. If death is due to accident, payment is made to the insured's beneficiary; if bodily injury is the result of an accident (such as the loss of a limb); the insured receives a specified sum. All state law enforcement officers, to include: correctional officers; correctional probation officers; firefighters; Florida Highway Patrol auxiliary officers; state attorney investigators; public defender investigators; members of bomb disposal units; full-time officers or employees of the state, as certified pursuant to Chapter 943, who serve, process, or attend to terms of circuit or county court as bailiffs; and members of organized militias while in active military service of the State, as provided in Sections 112.19, 112.191, and 250.34 of the Florida Statutes. This insurance is provided at a cost through the DMS.

Automobile Liability - Iinsures against third party bodily injury or property damage losses arising from the use or maintenance of vehicles. This insurance is mandatory for all State owned automobiles and is provided through the DFS.

Boiler & Machinery - Provides coverage for direct, accidental damage to objects within covered locations (Any location listed on a schedule with the insurance company.) Required inspections are provided at no additional charge. This insurance is provided at a cost to the department through the DMS.

Building and Contents Insurance - Provides insurance coverage for building and contents owned by the University for the specific perils of fire, lighting, windstorm, hail explosion, Riot, aircraft/vehicle damage, smoke, flood and sinkhole collapse. This insurance is mandatory and provided by the DFS.

Camp Insurance - Provides coverage for camp activities excluding athletic camps, conducted and supervised through a University Program. Travel to and from camp is also included as long as sites being traveled to are located on the University Campus. Coverage is provided for accidental death and specific loss along with accidental medical expenses. This coverage is provided by an outside insurance agency.

Civil Rights - Provides protection for employers against Civil Rights Acts based upon discrimination and retaliation by an employer on the basis of an individual’s race, color, religion, sex, national origin, age, handicap, or marital status. This insurance is mandatory and provided by the DFS.

Contractor’s Equipment - Provides coverage for all risks of direct physical loss or of damage to University Property. Types of equipment covered are mobile equipment, mobile machinery, and other miscellaneous property subject to a transportation feature. This insurance is provided at a cost to the department through the DMS.

Court Awarded Attorney Fees - Provides coverage for the payment of court awarded attorney fees when the University is involved in legal proceeding in which the University is not the prevailing party. This insurance is mandatory and provided by the DFS.

Crime - This insurance is provided to protect the University from monetary losses sustained as a result of employee dishonesty, theft, disappearance and destruction. This insurance is provided at a cost to the department through the DMS.

Electronic Data Processing Equipment - Provides coverage for electronic data processing equipment owned by the University and similar equipment owned by others in the University’s care, custody, and control. This coverage applies to all electronic media including converted data owned by the University and similar equipment owned by others in the University’s care, custody, and control. Scientific and medical equipment owned by the University and similar equipment owned by others in the care, custody, and control of the University are also covered under this policy subject to underwriting approval. This insurance is provided at a cost to the department through the DMS. Waterborne scientific equipment is not covered by this policy and but may be obtained under Miscellaneous Property.

Fine Art - Provides insurance for unique fine arts loaned to or owned by the University. Typical coverages are for museum collections, fine arts, murals, stained glass and sculptures. Coverage applies to sculptures both inside and out. This insurance is provided at a cost to the department through the DMS.

General Liability - Provides coverage for the University when negligent acts and/or omissions result in bodily injury and/or property damage to a third party. This insurance is mandatory and provided by the DFS.

Miscellaneous Property - Provides insurance against risk of direct physical loss or damage to University property unless the loss or damage is excluded. Items covered consist of museum collections, theatrical equipment and props, and other similarly unique items. This insurance is provided at a cost to the department through the DMS.

Ocean Marine - Provides insurance for all watercraft owned, leased or loaned to the University. It provides hull coverage to the watercraft, transit coverage while the vessel is being transported and indemnity coverage. This insurance is provided at a cost to the department through the DMS.

Workers’ Compensation - Provides coverage to employees for accidents which occur while at work. The employee must be in the course and scope of employment at the time the accident occurs. Work performed must be the major contributing cause of the injury. This coverage is statutorily required and provided by the DMS on behalf of the University.

Responsibilities

It is the responsibility of EH&S to provide all students, visitors, faculty and staff with information and assistance for obtaining insurance. EH&S will act as a liaison between the DFS, DMS, and the University for processing claims and obtaining insurance coverage. As needed, EH&S will provide training to the University community and work with individuals on a case by case basis to educate them on the State Insurance Program.

Additional Information

The Insurance Program of EH&S is divided into two separate categories, state mandated coverage which is administered by the DFS and for purchase insurance which is administered by DMS. For DFS administered coverage, the EH&S office works with the departments and injured persons to provide both education and assistance with the claims handling process. For DMS administered coverage EH&S works with the purchasing analyst at the DMS to obtain available coverage.
